Nathan Musgraves, a Union Pacific worker, has recently filed a Federal Employer’s Liability Act lawsuit against his employer after claiming to have suffered injuries when a door struck him in the back.
Working as a tie plug operator for Union Pacific’s Maintenance of Way Engineering Department, Musgraves states that he had been recently transferred to the Dupo facility that is also owned by the railroad. According to the lawsuit, at this yard, Musgraves duties required him to “enter and use an 18 wheeler box trailer to get a switch heater.”
The man’s injuries occurred when the door to the 18 wheeler box trailer slammed into his back. Musgraves claims to have suffered disabilities and disfigurement due to the injury. He also states that this injury has aggravated a pre-existing injury that now requires surgical treatments.
The lawsuit places the blame on Union Pacific for negligently failing to provide a latch to the door in order to secure it from slamming unto workers.
