Richard Beaver, an employee of the Kansas City Southern Railway, has filed a lawsuit against KCS and Kinder Morgan Petcoke after he was injured from a train derailment that occurred last year.
According to Beaver, he was injured when Kinder Morgan Petcoke “negligently caused the KCS train, rail cars and locomotives….to derail.”
The lawsuit also claims that Kinder Morgan Petcoke failed to properly inspect, repair, and maintain the track involved in the accident. It also claims that to warn Mr. Beaver of the possible dangers associated with his job as well as failed to uphold railroad regulations and standards.
Richard Beaver is protected by the Federal Employer’s Liability Act (FELA), which holds negligent employer’s responsible for injuries that their employees suffer due to their acts of negligence. Under FELA laws, Beaver is eligible to seek compensation for his injuries.
