Kevin Wengert recently filed a FELA lawsuit against his former employers after alleging that the noise exposure that he endured during his 13 year career with Alton & Southern Railway has caused him serious injuries. The trackman began his railroad career back in 1995 and now claims that the noise pollution has permanently damaged his hearing.
The Federal Employer’s Liability Act was passed in 1908 and works to protect railroad workers from injuries caused by the negligence of their employers. Employers are responsible to provide workers with a safe working environment, as well as equipment to protect them from injuries, such as ear plugs.
Wengert’s lawsuit claims that Alton & Southern failed to properly provide him with a safe working environment and failed to supply him with the necessary tools and equipment to complete his job in a safe manner.
Wengert seeks damages in excess of $50,000 and claims that his injuries will cause him to suffer for the rest of his life.
