Norfolk Southern Faces FELA Lawsuit

Norfolk Southern Railroad is facing a Federal Employer’s Liability Act lawsuit this month as a former conductor complains that he was not given a safe working environment in which to complete his job.

Lynn Whittaker, the conductor, states that he suffered serious injuries in February 2007 while working at the A.O. Smith rail yard. Whittaker claims to have suffered neck, knee, and shoulder injuries while he was walking through the yard during an ice storm and slipped on a frozen ballast, causing him to fall.

Whittaker claims that Norfolk did not provide him with a safe working environment by not providing him safe methods of work or a safe pathway on which to walk. He seeks damages for his pain, suffering, medical expenses, and lost wages.
