Illinois Central and Canadian National Face FELA Lawsuit

Canadian National and Illinois Central Railroad are facing a FELA lawsuit filed by a former employee. John O. Baine, a former engineer, claims to have suffered injuries to his neck, legs, and back as a result of his many years of employment with the railroad and the engine vibration that he was exposed to during this time.

FELA protects railroad workers from the injuries they may sustain while on the job. Excessive and repetitive vibrations are known to cause injury to joints and muscles over time. Baine argues that his employer’s negligence led to his injuries. He claims that Canadian National/Illinois Central failed to provide him a reasonably safe working environment. He also claims that the railroad failed to follow safety recommendations following an ergonomics study conducted in the early 1990s.

He reports to be suffering mental anguish, as well as physical pain from his injuries. He is seeking damages in excess of $50,000 for medical expenses and mental anguish, among other damages.
