The Tennessee Court of Appeals agreed with a $5 million judgment awarded to a railroad worker by a circuit court recently, ruling against an appeal by CSX Transportation which claimed that the statute of limitations had expired, that the judge’s charge was questionable, and that the plaintiff’s lawyer made an inappropriate closing statement.
Thurston Hensley, a former CSX employee, argued successfully in court that he had contracted asbestosis and encephalopathy while working for the railroad company. Hensley, an electrician, was awarded $5 million by a Hamilton County jury for his suffering.
