$5 Million Judgment for Railroad Worker Upheld

The Tennessee Court of Appeals agreed with a $5 million judgment awarded to a railroad worker by a circuit court recently, ruling against an appeal by CSX Transportation which claimed that the statute of limitations had expired, that the judge’s charge was questionable, and that the plaintiff’s lawyer made an inappropriate closing statement.

Fatalities Increase While Derailments Decline

According to the Federal Railroad Administration, a train derailment accident occurs somewhere in the U.S. on average every five hours. In 2007, 1,696 train derailments occurred nationwide from all railroad companies, down from 1,982 in 2006. Nationally, Union Pacific had 1,722 hazardous material releases, and 215 hazardous material cars were damaged or derailed.

Union Pacific Employee Sues for Repetitive Trauma Injuries

Norfolk Southern Worker Injured in Train Derailment

A Norfolk Southern Railroad employee was injured on February 13th when two train cars derailed at DeButts Railyard in Chattanooga, Tennessee. Mysteriously, the train was not moving according to railroad company representative Susan Terpe. She added that the train was not in a public area.
