A conductor employed by CSX Transportation Inc. has filed a lawsuit against his employer, claiming it failed to provide him a safe working environment. Aaron E. Richards, the plaintiff, alleged that he suffered injuries when a goose jumped out at him from under a railcar, causing him to fall. He claims that CSX had known previously about the goose nesting in the train yard, and violated its obligations under the Federal Employers’ Liability Act (FELA).
Richards is seeking damages in excess of $75,000, plus interest. He has demanded a jury trial.
