Injured Railroad Worker Sues Driver, Railroad

January 30th, 2008 · No Comments

In a case filed last week in the Orange County District Court, railroad worker Myron Lynn Reed made allegations of negligence against Union Pacific Railroad. According to the suit, in October of last year, Reed injured his back, neck, and shoulder as the result of a collision between a truck and the train Reed was operating. Reed claims Union Pacific Railroad was negligent in failing to provide him a safe place to work and failing to install cross arms at the railroad crossing to “prevent cars from entering.” The suit, which seeks punitive damages, as well as compensation for past and future mental anguish, lost wages, and medical expenses, also names truck driver Santiago Cadena and the trucking company J&S Builders as defendants, claiming both were also negligent in causing the accident.
