Eldwin Garrett is citing the Federal Employers Liability Act in a lawsuit against his employer, BNSF Railway Co. FELA was designed to protect the rights of railroad workers injured while working on for railroad companies. While installing an end-of-train device, Garrett suffered injuries cited in the lawsuit.
Garrett claims that BNSF Railway Co. was negligent and failed to provide him a safe place to work. He cites injuries to his shoulders, neck, and back. The suit, however, does not specifically go into detail on how he was injured while working. According to Garrett, he has suffered “physical and mental pain” due to his injuries and expects that his pain will continue for years to come. He is seeking damages for medical expenses and impairment.
If you have been injured while working on the railroad, you are protected under FELA. Contact a FELA Lawyer at Williams Kherkher for more information on how FELA applies to you and your injuries.
