Burlington Northern Santa Fe Railway Co. is being sued by James Smart after his sustained injuries to his knee while attempting to get off of a train. He cites the Federal Employers’ Liability Act in his claim.
FELA was deisgned to place the responsibility of railroad workers’ safety in the hands of their employers. Employer negligence is more often than not the cause of the employees’ injuries.
Smart worked on various tracks for BNSF Railway and claims that it was their negligence that caused him to fall and injure his knee while getting off the train.
Smart is seeking damages for mental anguish, lost wages, loss of earning capacity, physical impairment, medical expenses, and pain and suffering.
