FELA used in Wrongful Termination Case

Railroad employees in Oklahoma were awarded $145,00 in punitive damages for being wrongfully terminiated by their employer.

Fired for attempting to create a union, the three workers - Rick Morton, Paul Lister and Kris Puig, were working for Watco Cos Stillwater Central Railroad. Having no contract and wanting to feel secure in their jobs, the three workers contacted the Brotherhood of Locomotive Engineers and Trainment to talk about creating a union.

The three men were fired three days after attending a union meeting. Company management apparently caught wind that the three had attended a union meeting and decided to fire them soon after.

Realizing the many safety and health issues at the company, the men thought it would be in their best interest to form a union. All of the men reported regulation violations as well as unsafe operations occuring at work.
