After 38 years with BNSF Railway Co., Alex Frausto claims to have suffered injurious trauma to his back, knees, shoulder, and neck in the course and scope of his employment. To recover for injuries sustained, Frausto filed suit in Jefferson County against his employer pursuant to FELA, the Federal Employers Liability Act.During his tenure with BNSF, Frausto worked as a maintenance-of-way trackman. As a result of his work, he acquired severe bodily injuries which occurred over a protracted period of time and resulted from his employer’s negligence including, but not limited to, failing to provide safe and proper tools; failing to provide adequate manpower; failing to enact and enforce safety policies and procedures; and, failing to provide proper instruction and supervision.In addition to medical expenses, Frausto is suing for past and future physical pain, lost earnings, disfigurement, and impairment. His case will be tried to a jury in the 136th Judicial District of Jefferson County, Texas.
