FELA Lawsuit Filed by Illinois Central Railroad Employee

Timothy Story, an Illinois Central Railroad employee, has recently filed a Federal Employer’s Liability Act lawsuit after suffering injuries related to his duties at work. Story has worked for the railroad since 1970 as a repairman and machine operator.

Since that time, he has been subjected to repetitive stresses on his spine and back due to heavy lifting and other strenuous motions required by his job.  The lawsuit claims that Illinois Central Railroad was negligent in requiring Story to lift, carry, and move objects that were dangerously heavy for extended periods of time.

The Federal Employer’s Liability Act protects the rights of workers who have been injured due to the neglience of their employers. This Act ensures that if you are injured because of the negligent actions of your employer, you have the right to take legal action against them in an effort to recover some of the damages you have sustained.

2 Million Dollar Verdict for FELA Engineer

A railroad engineer of 33 years recently won a 2 million dollar verdict in the case of Lockley v. CSX. Lockley, 53, was subjected to years of repetitive trauma to his cervical spine. He was diagnosed with carpal tunnel syndrome, however, it was a neck MRI that eventually showed the damage to his cervical disc. This injury ultimately led to the end of Lockley’s career with CSX in 2007.

Lockley underwent surgery to correct his medical problems, but continues to suffer pain post-surgery, requiring injections in his neck for many years to come.

The lawsuit filed stated that his future medical expenses would total $50,000. In addition his past lost income was calculated at $100,000 and his future lost wages totaled $850,000.

Despite the CSX’s attempts to discredit Lockley’s claims, the jury awarded the man 2 million dollars to cover the cost of his damages.

Dock Worker For Norfolk Southern Files FELA Lawsuit

A Federal Employer’s Liability Act lawsuit has recently been filed by James McDaniels, a dock worker for Norfolk Southern Railway. McDaniels is a 41 year veteren employee of the railway.

Acting as a dock worker from 1966 to 2007, McDaniels claims to have been injured over many years due to repetitive traumas. He claims that these traumas resulted from decades of loading and unloading materials during his work day.

The lawsuit claims that McDaniels was not provided safe or adequate tools to be able to properly and safely complete his job, among other complaints.

The Federal Employer’s Liability Act protects railroad employees from the negligent actions of their employers. FELA Ear Loss Injury Leads to FELA Lawsuit

A former employee of Norfolk Southern Railway Company has recently filed a lawsuit against the railway after suffering severe ear damage. The employee places the blame for his injury on inadequate equipment.

Anthony Cavalier, the former employee, suffered injuries to his ears, inner ears, eardrums, tympanic membrane, and the nerve endings inside of the ear.

According to the lawsuit, Cavalier has lost a great deal of his hearing and now suffers from tinnitus. He claims that his injuries are a result of his employer’s negligence. The lawsuit states that the railway company did nothing to reduce the dangerous noise level of the working environment, despite the standards allowed under OSHA and the Federal Railroad Administration. The horn was also improperly positioned so that it blew directly into the crew members’ ears.

Back Injuries Lead to FELA Lawsuit

William Lakin, a former railroad employee, has filed a suit against his former employer after claiming to have suffered back injuries while working for the railroad company. While working as a conductor, brakeman, and switchman for Union Pacific Railroad Company, Lakin claims to have suffered back injuries to the spine, nerves, and spinal discs.

The lawsuit states that Lakin’s injuries forced him to seek medical attention, causing expensive medical bills, as well as pain and suffering. The lawsuit also states that Union Pacific failed to provide their employees with a safe working environment, directly caused Lakin to suffer cumulative trauma, and provided inadequate training and safety equpiment.
