Unsafe Working Environments Push Railroad Employees to File Lawsuits

BNSF Railway Company faces a Federal Employer’s Liability Act lawsuit after a former employee claims to have been exposed to unsafe working conditions throughout his career with the railroad.

James Moss, the longtime BNSF engineer, claims that he suffered serious injuries to his hands, fingers, elbows, and wrists during his time at BNSF. He states that these injuries will most likely stay with him for the rest of his life, causing pain for many years to come.

Moss states that BNSF negligently failed to provide him and his co-workers safe working conditions and failed to provide him with the safe equipment needed to complete the tasks of his job.

He seeks damages for his medical expenses, pain and suffering, lost wages, and loss of enjoyment of life.

Norfolk Southern Faces FELA Lawsuit

Norfolk Southern Railroad is facing a Federal Employer’s Liability Act lawsuit this month as a former conductor complains that he was not given a safe working environment in which to complete his job.

Lynn Whittaker, the conductor, states that he suffered serious injuries in February 2007 while working at the A.O. Smith rail yard. Whittaker claims to have suffered neck, knee, and shoulder injuries while he was walking through the yard during an ice storm and slipped on a frozen ballast, causing him to fall.

Whittaker claims that Norfolk did not provide him with a safe working environment by not providing him safe methods of work or a safe pathway on which to walk. He seeks damages for his pain, suffering, medical expenses, and lost wages.

Railroad Worker Injured After Tripping on Debris

A Federal Employer’s Liability Act lawsuit has been filed after a railroad employee claims to have suffered injuries from tripping over a pile of debris. The Kansas City Southern Railway is named as the defendant in the case.

Darrie Londow, the former employee, was working on maintenance work for Kansas City Southern when he tripped on debris and was injured. The lawsuit states that “the injuries to the Plaintiff were due in whole…to the negligence of Defendant.” It also states that he suffered injuries to his back, among other parts of his body.

The lawsuit does not go into any detail about the manner in which the railroad was negligent, however, it does mention that he is seeking damages for lost earnings, medical expenses, disfigurement, mental anguish, and impairment.

Worker Files FELA Suit After Train Derails

An employee of the Kansas City Southern Railway is suing the railroad after suffering injuries on the job. The man, Richard Beaver, claims to have suffered serious injuries atfter a train derailed last year.

Beaver claims that while working on a Kansas City Southern Railway train, Kinder Morgan Petcoke, L.P. negligently caused the train to derail. This, in turn, lead to the injury of Beaver’s lower back and other parts of his body.

Kinder Morgan Petcoke, L.P. handles millions of tons of petroleum coke, aggregates, soda ash and potash through terminals throughout the Texas Gulf Coast.

Under the Federal Employer’s Liability Act, Beaver is suing KCS for failing to provide him a safe working environment. He is seeking damages from KMP as well.

FELA Lawsuit: Illinois Central Blamed for Wrist and Shoulder Injury

Illinois Central Railroad is facing a Federal Employer’s Liability Act lawsuit after a former employee claims he suffered injuries to his wrist and shoulder.

Donald Grammer, who has worked as a brakeman and switchman for a variety of railroads since 1964, claims to have suffered injuries as a result of repetitive occupational trauma.

Grammer claims to have suffered excessive trauma to his wrists and right shoulder while performing his duties at work. He also claims that his former employer is negligent for failing to provide a safe working environment.
